Resumen:

La transición del sistema de justicia penal inquisitorio a uno de corte acusatorio, representó un cambio significativo en la forma de procesar los delitos, dando paso a un modelo que promueve la suavización de las penas, sobre todo en delitos no graves, esto debido a la relevancia que han cobrado los derechos humanos, dando oportunidad que el imputado pueda llevar su proceso en libertad. Existe un desconocimiento general sobre este proceso y los derechos del imputado. Ante un capitalismo global, la sociedad se expone quedando aún más vulnerable, la exclusión social es más notoria y afecta sobremanera al sector marginado de la población volviéndoles víctimas de la violación y ejercicio pleno de sus derechos humanos. Este sistema demuestra que no hay una disminución de delitos, por el contrario, el que delinque ya sabe cómo es el proceso y no teme por él, permitiendo así la reincidencia; puesto que existe la oportunidad de llevar a cabo el proceso en libertad. La presente investigación es de corte cualitativo y se llevó a cabo bajo la aplicación de entrevistas semiestructuradas, bajo la limitante que en su proceso se presentó; la emergencia sanitaria a nivel mundial. Sin embargo, concatenando la teoría con la información recabada se puede concluir que el nuevo sistema de justicia acusatorio, da la oportunidad de llevar el proceso en libertad, suavizar las penas, y con ello, permitir la reincidencia de los imputados.

Abstract:

The transition from an investigative penal justice system to an accusatory type, has become a significant change on how felonies are processed, providing a path to a model that softens the sentences, most of all in crimes cataloged as minor offenses; this, due to the relevance that human rights have gained providing to the indicted the opportunity to carry on with his process without being detained. There is a general lack of awareness regarding this process and the rights of the indicted, as in a global capitalism, society has become more vulnerable than ever, social exclusion is even more notorious and the people with the lowest incomes are greatly affected, as they become victims in violating and exercising their own human rights. This system, has demonstrated that felonies have not diminished, quite the contraire, felons are aware of the softness that the system has and they do not fear it, and this allows for the felon to commit crime again; given that the trial is being carried on while the subject is free to walk the streets. The herein research is from a qualitative nature, and it was taken under semi-structured interviews with the limitation of the global sanitary emergency. However, concatenating the provided theory with the information gathered for this research, we can conclude that the new accusatory justice system, provides the opportunity to have the process in freedom, it softens the given sentence providing an opportunity for the indicted one to continue committing felonies.
