En México, la Procuraduría Federal de Protección al Ambiente (PROFEPA) es la institución responsable de vigilar el cumplimiento ambiental, bajo el esquema del Programa Nacional de Auditoría Ambiental (PNAA) lleva a cabo verificaciones concertadas con las industrias y tras la realización de las acciones correctivas necesarias otorga el Certificado de Industria Limpia (CIL). La presente investigación tiene como objetivo analizar la organización e implementación del CIL como instrumento de política ambiental en aras de disminuir los impactos de la actividad industrial de México. Para ello se comparó la gestión de la implementación del CIL con la propuesta del modelo de Gestión Ambiental Estratégica (GAE), que propone una mejora regulatoria integral como base para incorporar la sustentabilidad. También se realizaron entrevistas semiestructuradas a servidores públicos de la PROFEPA, auditores ambientales e investigadores académicos; se llevó a cabo una revisión secundaria exhaustiva sobre temas de gestión ambiental, auditoría ambiental y del CIL; además se usaron bases de datos de la PROFEPA para establecer tendencias históricas de certificación, así como su distribución en el país. Entre los principales resultados obtenidos se encuentra que la CIL se ha implementado bajo un modelo de gestión “tradicional”, que funciona principalmente para lograr que la industria cumpla con la normatividad ambiental, es decir, para mejorar el desempeño ambiental de las empresas es necesario que este instrumento se aplique en conjunto con sistemas de gestión ambiental que promuevan la mejora continua de resultados.
In Mexico, The Federal Attorney for Environmental Protection (PROFEPA by its initials in Spanish) is the institution that is responsible of monitoring the fulfillment of the environmental law, according to the National Environmental Audit Program (PNAA by its initials in Spanish) scheme, PROFEPA performs concerted verifications with the industries and after the application of the corrective reforms in the industries, it grants the Clean Industry Certificate (CIL by its initials in Spanish). The Objective of the current investigation is to analyze the organization and implementation of the CIL as an instrument of environmental policy in favor of diminishing the impact of the industrial activity in Mexico. For this purpose, it was compared the implementation of the CIL with the Strategic Environmental Management (GAE by its initials in Spanish), the last one proposes an Integral regulation as a foundation to incorporate the sustainability. Also semi-structured interviews were conducted with public servants of PROFEPA, environmental auditors and Academic researchers; it has been performed an exhaustive secondary revision about the following topics: Environmental management, environmental auditing and about the CIL; also the Data Bank of PROFEPA was used in order to establish historic tendencies of certification, as well as its distribution in the country. Among the main results it was obtained that the CIL has been implemented under a “Traditional” Management model, that operates mainly in order to accomplish that the industry follows the environmental law, in other words, to improve the environmental development of the enterprises it is necessary to apply this instrument in conjunction with the environmental management systems that promotes the continuous improvement of results.
